My husband went and took out a second mortgage on the house on my name. What do I do?
Wednesday, 11. August 2010
He went and signed my name on the legal mortgage papers, and the mortgage company knew about this. I had no clue, I just found out. The mortgage is on forclosure now. Do you have any solutions as to what I should do

House is in both your names? If house were only in your name I think you could rescue the house . Here if house in both names it could be more difficult. Are you willing to charge him with fraud? If not probably live and learn. You need a lawyer and may need to file fraud charges. Joy did not authorize him to sign. Have you tclked to the mortgage co. Problem is he owes it and if house in both names, then if one owes they take it.
You may have bigger priblems than foreclosed house. He have gambling problem? That would be my guess. If he stole for girlfriend andvwere me I’d need an attorney. I might kill the fx??$&&$7$&
Goof luck

It’s fraud. Get a lawyer. Your husband cannot sign your name to anything. You are the only one who can do that. The mortgage company should not have accepted his signature in lieu of yours. You can probably sue the crap out of them, too.

It’s bank fraud no matter how you look at it. Notify the bank immediately and just tell them of the fraud. You’ll probably has to sign an affidavit of fraud. They’ll go after your husband for the fraud. You should also put the account on fraud alert through Trans Union Fraud Dept. Their toll free # 1-800-680-7289. They’ll notify the other 2 bureaus and must be renewed every 90 days in order to keep it active. I realize the damage already has been done, but if he tries again, they have to notify you before it can be approved. You might as well run your free credits reports from annualcreditreport.com or just call Trans Union toll free @ 1-877-322-8228 for all 3 free reports. If there is something on the reports you’re not aware of, dispute it immediately. .
