I was given a second as a promissory note that I recorded on my house sale. When I google-earthed it, the house looked empty but could not see a for sale sign. Getting worried.

    Those google earth pictures are not current. I have seen them over years old.

    They should have to file a foreclosure with the county. I hope you recorded your lien. If they are paying you they are probably paying the first mortgage.

    contact a realtor in the area and give him the address and he can check and see if it is for sale and what kind of sale it is…,if it is in foreclosure or not…good luck

    If you have the second you need to go to the title company and have a title search ran as if the house is in foreclosure because of taxes or any government entity, then all secondary notes are erased and you might need to see where exactly you are in line on the title if there are any liens (clouds) on the title that may take precedent over your promissory note then your SOL. On the title you can contact the financial institution who holds the note to find out if it is in foreclosure or not. But having it recorded should allow you to take legal recourse if necessary.
